Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Oxygen website at oxy.tech (“Site”) operated by Titanium Intelligence, Inc. DBA Oxygen Intelligence (“Oxygen,” “we,” “us,” or “our”). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Oxygen. By visiting the Site, submitting a demo request, or otherwise interacting with any content or functionality on the Site, you confirm that you are at least 16 years old and have the legal capacity to enter into these Terms on behalf of yourself or the entity you represent.

If you are using the Site on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

2. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be indicated by updating the “Last updated” date above. We encourage you to review these Terms periodically. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.

3. Use of the Site

3.1 Permitted use

Subject to these Terms, Oxygen grants you a limited, revocable, non-exclusive, non-transferable licence to access and use the Site for lawful informational and business evaluation purposes.

3.2 Prohibited conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation;
  • Attempt to gain unauthorised access to any part of the Site or its underlying systems;
  • Scrape, crawl, or use automated means to collect data from the Site without our prior written consent;
  • Introduce viruses, malware, or other malicious code;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity;
  • Use the Site in any manner that could damage, disable, or impair its operation or interfere with any other party’s use.

4. Intellectual Property

The Site and all content, features, and functionality—including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, and the design, selection, and arrangement thereof—are the exclusive property of Oxygen or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Site, except as follows:

  • Your computer or browser may temporarily store copies of materials incidental to normal web browsing;
  • You may print or download one copy of a reasonable number of pages for your own personal, non-commercial use only.

The Oxygen name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Oxygen Intelligence, Inc. You may not use them without prior written permission.

5. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by Oxygen, including our demo-request form hosted by Typeform, Inc. and documentation hosted by Mintlify. Oxygen has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

We strongly advise you to read the terms and privacy policies of any third-party sites you visit. Links on the Site do not constitute an endorsement by Oxygen of those sites or services.

6. Disclaimer of Warranties

The site is provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Oxygen does not warrant that: (a) the Site will be uninterrupted or error-free; (b) defects will be corrected; (c) the Site or the server that makes it available are free of viruses or other harmful components; or (d) the results of using the Site will meet your requirements.

7. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Oxygen, its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your use of or inability to use the site; (b) any content on the site; (c) unauthorised access to or alteration of your transmissions or data; or (d) any other matter relating to the site.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, Oxygen’s liability is limited to the maximum extent permitted by law. Oxygen’s total cumulative liability to you for any claim arising from these Terms or your use of the Site shall not exceed USD $100.

8. Indemnification

You agree to defend, indemnify, and hold harmless Oxygen and its affiliates, licensors, service providers, employees, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Site.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site you consent to the collection and use of information as described in the Privacy Policy.

10. Platform Services

These Terms govern your use of the Site only. Use of the Oxygen platform product is governed by a separate Master Service Agreement or other written agreement executed between you and Oxygen. Nothing on the Site constitutes an offer to enter into a binding services agreement.

11. Geographic Restrictions

Oxygen is based in the United States. We make no representations that the Site is appropriate or available for use in other locations. Accessing the Site from jurisdictions where its content is illegal is prohibited. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

12. Governing Law and Disputes

These Terms and any dispute arising out of or related to them or the Site shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any choice or conflict of law provisions.

Any legal suit, action, or proceeding arising out of or relating to these Terms or the Site shall be instituted in the federal or state courts located in Delaware. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

13. Waiver and Severability

No waiver by Oxygen of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition. If any provision of these Terms is held by a court to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy and any applicable Master Service Agreement, constitute the entire agreement between you and Oxygen with respect to the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties relating to the Site.
